Last updated: 9 October 2026
These Terms and Conditions ("Terms") govern your access to and use of the Mov-IX website, platform, and related services (collectively, the "Platform" or "Services") trading as Mov-IX.
By registering an account, accessing, browsing, or using the Platform, or by booking or offering any transport service through it, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Important notice under the Consumer Protection Act 68 of 2008 ("CPA")
Certain clauses below limit our risk or liability, require you to assume risk or liability, impose an indemnity, or contain acknowledgements of fact. These are specifically drawn to your attention in accordance with section 49 of the CPA. Please read them carefully before accepting these Terms. They appear in bold for emphasis: see in particular clause 5.3 (risk in the goods), clause 9.1 (exclusion of liability), clause 9.2 (limitation of liability) and clause 9.5 (indemnity).
1. Definitions
- "Transporter"/"Carrier" means any independent truck, van, flatbed or any other vehicle owner/operator who registers on the Platform to offer transport services.
- "Mover"/"Shipper" means any person who uses the Platform to request or book the transport of goods.
- "User" means any Transporter/Carrier, Mover/Shipper or other person who accesses or uses the Platform.
- "Shipment" means the goods to be transported from the collection address to the delivery address as booked through the Platform.
- "Platform Fee" means the fee charged by Mov-IX for facilitating the transaction, displayed at the time of booking and deducted from the amount payable to the Transporter/Carrier. The Platform Fee is refundable where a booking is cancelled through no fault of the Mover/Shipper.
- "Business Day" means any day other than a Saturday, Sunday or public holiday in the Republic of South Africa.
2. Nature of the Service: Intermediary Only
2.1 Mov-IX operates an online community Platform that enables independent Transporter/Carriers to advertise available routes, capacity and services, and enables Mover/Shippers to search for, select and book such services.
2.2 We are a pure intermediary / facilitation platform. We do not:
- own, operate, control or provide any vehicles;
- employ or control any Transporter/Carriers;
- take possession of, handle, store, load, unload or transport any goods;
- act as a Transporter/Carrier, freight forwarder, logistics provider, insurer or agent of either party in the performance of the transport itself.
2.3 The contract of carriage is formed directly between the Mover/Shipper and the selected Transporter/Carrier. Mov-IX is not a party to that contract of transport/carriage.
2.4 Our role is limited to:
- providing the matching on the advertising Platform;
- facilitating the quotation and booking process;
- collecting payment securely via PayFast (or such other payment gateway as we may use);
- instructing the payment gateway to hold the funds and release them to the Transporter/Carrier (less any Platform Fee) after confirmed delivery completion, in accordance with clause 6. Refer to "Payfast Pricing" at the end of this document.
3. Acceptance and Eligibility
3.1 By creating an account or using the Services you confirm that you are at least 18 years old, have full legal capacity, and (if registering as a Transporter/Carrier) are lawfully entitled to operate the vehicle for commercial hire or reward under South African law.
3.2 Registration requires a valid South African mobile number and email address. We will send verification codes/links. You must complete verification before full access is granted.
3.3 You are responsible for keeping your login credentials confidential and for all activity under your account.
3.4 These Terms apply to both consumers and business users. Where you are a consumer for purposes of the CPA (a natural person, or a juristic person whose asset value or annual turnover is below the threshold determined under section 6 of the CPA, currently R2 million), nothing in these Terms excludes, limits or overrides any right you have under the CPA, and these Terms must be read subject to the CPA.
4. Transporter/Carrier Registration and Obligations
4.1 Transporter/Carriers must provide accurate vehicle, route, capacity, pricing and contact details and keep them current.
4.2 Transporter/Carriers remain solely responsible for:
- holding all required licences, permits, roadworthy certificates and insurance;
- the safe loading, securing, transport and unloading of goods;
- compliance with all road traffic, dangerous goods and other applicable laws;
- any loss, damage or delay caused to the Shipment or third parties.
4.3 Transporter/Carriers acknowledge that they are independent contractors and not employees, agents or partners of Mov-IX.
4.4 Mover/Shippers must satisfy themselves as to a Transporter/Carrier's suitability before booking.
5. Mover/Shipper Responsibilities
5.1 Mover/Shippers must provide accurate descriptions of the goods (nature, dimensions, weight, value, special handling requirements), pickup and delivery addresses, and contact details.
5.2 Mover/Shippers are solely responsible for:
- packing and preparing goods adequately for transport;
- being present (or arranging a responsible adult) at the agreed pickup and delivery times;
- declaring any high-value, fragile, hazardous or prohibited items;
- obtaining any required permits or documentation for the goods.
5.3 Risk in the goods passes to the Transporter/Carrier while the goods are in the Transporter/Carrier's custody, and passes to the Mover/Shipper (or nominated recipient) on acceptance of delivery. Mov-IX does not at any time take custody of, or bear any risk in, the goods.
5.4 Cargo declaration. When making a booking the Mover/Shipper must select, from the list shown on the Platform, the type of cargo being shipped (Non-Hazardous Material, Hazardous Material, Liquid – Hazardous, Liquid – Non-Hazardous, Livestock, Animal Feed, or Very Fragile (Glass or other)); must describe the cargo where the Platform asks for a description (which it does for every type other than Non-Hazardous Material); and must confirm, by ticking the declaration on the booking form, that the cargo has been described accurately and in full, that it contains no firearms or explosives, and that the Mover/Shipper has read the notices on the booking form. The declaration is recorded with the booking, together with the date and time at which it was made, and is shown to the Transporter/Carrier and to the driver.
5.5 Failure to disclose a Hazardous item or livestock will result in legal action being taken against the Mover/Shipper. A Mover/Shipper who does not disclose Hazardous Material, hazardous liquids or livestock, or who describes cargo inaccurately, is in breach of these Terms and remains liable, under the indemnity in clause 9.5, for all loss, damage, fines and costs that result. The Transporter/Carrier and Mov-IX may refuse, stop or cancel the carriage of cargo that has not been declared, or has been declared inaccurately.
6. Booking, Pricing and Payment
6.1 Prices displayed are estimates or fixed quotes provided by Transporter/Carriers (or generated via the Platform algorithms based on Transporter/Carrier input). Final price is confirmed at booking. All prices are in South African Rand (ZAR). Where a Transporter/Carrier is a registered VAT vendor, VAT is included in the quoted carriage price and the Transporter/Carrier is responsible for issuing any tax invoice for the carriage; where a Transporter/Carrier is not a VAT vendor, no VAT applies to the carriage price. Mov-IX issues a tax invoice only for its Platform Fee, where applicable.
6.2 Payment is processed securely through PayFast (or successor gateway). Funds are collected and held by the payment gateway pending delivery confirmation; Mov-IX does not itself hold User funds. Please see "Payfast Pricing" at the end of the terms document.
6.3 Upon confirmed successful delivery (via the Platform process or other verification we accept), the payment gateway will be instructed to release the Transporter/Carrier's portion of the funds (less our Platform Fee of: 30% of the booking price and Payfast transaction pricing) to the Transporter/Carrier's nominated bank account within 2 (two) Business Days. Delivery is confirmed when the Mover/Shipper (or nominated recipient) confirms receipt on the Platform, or when proof of delivery is uploaded and no dispute or claim under clause 8.5 is raised within 48 hours of upload. Where a claim is notified under clause 8.5 before release, we will treat the payment as disputed and deal with the funds in accordance with clause 6.4.
6.4 If delivery is not completed, is disputed, or the Shipment is cancelled in accordance with these Terms, we will deal with the funds in accordance with the cancellation/refund rules below or as directed by a competent authority.
6.5 Chargebacks, payment disputes or fraudulent transactions may result in suspension of accounts and recovery of amounts from the responsible User.
7. Prohibited and Restricted Items
7.1 The following may not be transported via the Platform:
- illegal goods, drugs, weapons, explosives, stolen property;
- hazardous materials, dangerous goods, chemicals, radioactive materials (unless the Transporter/Carrier is specifically licensed and has agreed in writing);
- live animals (except as expressly agreed);
- cash, bullion, jewellery, precious stones, negotiable instruments of high value, or other high-risk items unless specifically declared and accepted by the Transporter/Carrier with appropriate insurance.
7.2 We and/or the Transporter/Carrier reserve the right to refuse any Shipment that poses a safety, legal or practical risk.
7.3 No firearms or explosives may be shipped using Mov-IX. Failure to abide by this rule will result in Mov-IX reporting the items to the South African Police Service (SAPS) or the relevant authority.
7.4 Hazardous Material, Liquid – Hazardous and Livestock may be booked only if they are declared as such under clause 5.4. A load declared in one of these categories is flagged to the Transporter/Carrier and to the driver. Declaring a load does not oblige a Transporter/Carrier to carry it: the Transporter/Carrier remains responsible, under clause 4.2, for holding the licences and permits that the load requires, and may refuse or cancel the booking under clause 7.2.
8. Cancellation, Non-Performance and Refunds
8.1 Cancellation rights and any applicable fees are set out in the cancellation schedule published on the Platform and displayed at the time of booking. Any cancellation fee will be a reasonable charge as contemplated in section 17 of the CPA, determined with regard to the timing of the cancellation and the Transporter/Carrier's reasonable losses.
8.2 No general cooling-off right applies to a confirmed booking for transport on a specific date or within a specific period, as such services are excluded from the cooling-off right in the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") by section 42(2)(j) of ECTA. Consumers retain the right under section 17 of the CPA to cancel an advance booking, subject to a reasonable cancellation fee, and the section 16 CPA cooling-off right where the booking results from direct marketing.
8.3 If a Transporter/Carrier fails to collect or deliver as agreed without valid reason, the Mover/Shipper may request a refund of amounts paid, including the Platform Fee. We will investigate and decide in good faith.
8.4 Refunds, where due, will be processed via the original payment method within 10 (ten) Business Days.
8.5 Any claim for loss of or damage to goods should be noted at delivery where reasonably possible and must be notified via the Platform within 3 (three) Business Days of delivery. Such claims lie against the Transporter/Carrier under the contract of carriage. Mov-IX will provide reasonable assistance, including booking and delivery records, to enable the claim to be pursued.
9. Liability, Insurance and Indemnity (Important: CPA s 49 notice)
This section contains clauses of the kind referred to in the section 49 notice at the start of these Terms. Please read this section together with that notice.
9.1 To the maximum extent permitted by South African law, and except to the extent that the loss is caused by our own fraud, gross negligence or wilful misconduct, Mov-IX accepts no liability for:
- any loss, damage, destruction, theft, delay or deterioration of any goods;
- any acts, omissions, negligence or misconduct of any Transporter/Carrier or Mover/Shipper;
- any personal injury, death or property damage arising from the transport;
- any failure of a Transporter/Carrier to perform the carriage;
- any indirect, consequential, special or economic loss (including loss of profit, business or opportunity).
9.2 Our total aggregate liability to any User arising out of or in connection with the Platform or these Terms (whether in contract, delict or otherwise) is limited to the Platform Fee paid by, or deducted in respect of, that User in respect of the specific transaction giving rise to the claim, or R1 000, whichever is the greater.
9.3 Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any other liability that cannot lawfully be excluded under the CPA or other mandatory South African law.
9.4
- Mov-IX does not insure goods on behalf of Mover/Shippers – moving/shipping is done at the user's own risk.
- Mover/Shippers are strongly advised to arrange their own all-risk transit insurance through any of the registered insurance companies who cover such risk. Mov-IX does not provide insurance cover for goods at this stage. We reserve the right to include insurance cover through a registered FSP in the future.
- Transporter/Carriers are responsible for their own vehicle and public liability insurance.
9.5 Each User indemnifies and holds Mov-IX, its directors, employees and agents harmless against all claims, losses, damages, costs and expenses arising from:
- the User's breach of these Terms;
- the User's negligence or wilful misconduct;
- any claim by a third party arising from the User's use of the Platform or the transport of goods;
- any inaccurate information provided by the User.
This indemnity applies only to the extent that the relevant claim, loss or damage was caused by the User, and does not apply to the extent caused by Mov-IX's breach, fraud, gross negligence or wilful misconduct.
10. Intellectual Property and Platform Use
10.1 All content, software, branding and technology on the Platform remain our property or that of our licensors.
10.2 You may use the Platform only for lawful purposes and in accordance with these Terms. You may not scrape, reverse-engineer, disrupt or misuse the Platform.
10.3 You retain ownership of content you upload to the Platform (including proof of delivery, photographs, ratings and reviews) and grant Mov-IX a non-exclusive, royalty-free licence to use that content to operate the Platform, process bookings, resolve disputes and improve the Services.
11. Privacy and POPIA
11.1 Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our separate Privacy Policy (available on the Platform). We process personal information where necessary to conclude and perform our contract with you, to comply with law, or to pursue legitimate interests (including verification, payment processing, dispute resolution and Platform security), and with your consent where the law requires consent (including for direct marketing). The Privacy Policy sets out full details, including the Information Officer's contact details.
11.2 The Platform (including the website, databases and related systems) is hosted on cloud servers that may be located outside South Africa. Your personal information may therefore be transferred to, stored on and processed by servers outside South Africa. Any such transfer is made in accordance with section 72 of POPIA, on the basis of contractual safeguards imposing protections substantially similar to POPIA and because the transfer is necessary to perform our contract with you. Full details are set out in the Privacy Policy found on the website.
12. Suspension and Termination
We may suspend or terminate any account or access immediately if you breach these Terms, provide false information, engage in fraudulent activity, or where required by law or reasonably necessary to protect the integrity or security of the Platform. Except in cases of fraud, unlawful conduct or serious risk, we will give you reasonable notice and an opportunity to remedy the breach before suspension or termination. Funds relating to Shipments in progress will be dealt with in accordance with clause 6. Outstanding obligations (including payment release rules) survive termination.
13. Dispute Resolution
13.1 In the first instance, Users should attempt to resolve disputes between Mover/Shipper and Transporter/Carrier directly. We may (but are not obliged to) assist in facilitating communication.
13.2 Any dispute between a User and Mov-IX arising out of these Terms shall first be referred to good-faith negotiation. If unresolved within 30 days, either party may refer the matter to arbitration in accordance with the Arbitration Act 42 of 1965 under the rules of the Arbitration Foundation of Southern Africa (AFSA), held in South Africa in English before a single arbitrator, or approach the courts. A consumer is not obliged to arbitrate and may pursue any statutory remedy or approach the courts instead.
13.3 Consumers retain all rights to approach the National Consumer Commission, Consumer Tribunal, the Consumer Goods and Services Ombud (www.cgso.org.za) or other statutory bodies.
14. Governing Law and Jurisdiction
These Terms and any dispute arising from them are governed by the laws of the Republic of South Africa. Subject to clause 13, the courts of South Africa have exclusive jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. We will give at least 15 days' notice of material changes via the Platform or email. If you do not accept the revised Terms, you may close your account before the effective date; bookings already confirmed remain subject to the Terms in force when they were made. Continued use after the effective date constitutes acceptance of the revised Terms.
16. General
16.1 If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
16.2 These Terms (together with the Privacy Policy and any specific booking confirmation) constitute the entire agreement between you and Mov-IX regarding the Platform.
16.3 No waiver of any breach is effective unless in writing.
16.4 Neither party is liable for failure or delay in performance caused by events beyond its reasonable control (including natural disasters, strikes, riots, power or network failures, or acts of government), provided the affected party notifies the other and resumes performance as soon as reasonably possible. This clause does not affect a consumer's statutory rights.
16.5 Users may not solicit, accept or make payment for any transport service introduced through the Platform outside the Platform with the intention of avoiding the Platform Fee. We may recover the Platform Fee that would have been payable and may suspend or terminate accounts involved in circumvention.
16.6 Notices under these Terms may be given via the Platform, by email to the address on the User's account or, to Mov-IX, to the contact details in clause 17. A notice is deemed received on the first Business Day after it is sent.
16.7 We may cede, delegate or assign our rights and obligations under these Terms to a successor of the Platform business on notice to you, provided your rights are not materially prejudiced. You may not cede or assign your rights or obligations under these Terms without our prior written consent.
16.8 You consent to receiving communications and concluding transactions electronically. Electronic records and communications satisfy any requirement in these Terms that a notice, waiver or agreement be in writing, as contemplated in ECTA.
