We do not intentionally collect special personal information (as defined in POPIA, e.g. race, health, biometric data, criminal behaviour) unless you consent or another ground in section 27 of POPIA applies, and it is strictly necessary for a specific purpose.
4. Sources of Personal Information
We collect personal information from:
- You directly (when you register, complete forms, book or offer services, or contact us)
- Your use of the Platform (automatically collected technical data)
- Third-party service providers (e.g. payment gateway confirmation of successful payment)
5. Why We Process Your Personal Information (Purposes)
We process personal information for the following specific purposes:
- To create and manage your account and verify your identity (email and phone verification)
- To enable Shippers and Carriers to find, book and perform transport services
- To process payments securely via PayFast (or successor gateway), which collects funds
- To communicate with you about bookings, delivery status, account matters and support
- To prevent fraud, enforce our Terms and Conditions, and protect the security of the Platform
- To comply with legal obligations (including tax, financial and regulatory requirements)
- To improve the Platform, analyse usage and develop new features
- To send service-related notices and, where you have consented, marketing communications
- To transfer funds (less commission and transaction fees) upon successful delivery of goods as a transporter.
6. Legal Basis for Processing
We process personal information on the following lawful bases under POPIA:
- Consent: where you have given us permission (e.g. marketing, optional cookies)
- Contract: where processing is necessary to perform our agreement with you (account, booking facilitation, payment handling)
- Legal obligation: where we must process information to comply with South African law
- Legitimate interests: where processing is necessary for our legitimate interests (Platform security, fraud prevention, service improvement), provided those interests are not overridden by your rights
7. Is Provision of Information Mandatory or Optional?
Certain information is required for us to provide the Services (name, verified email, verified phone number, booking details, addresses and for Carriers, vehicle and bank details). If you do not provide this information we may be unable to create an account, process a booking, or release payment.
Other information (e.g. marketing preferences, optional profile details) is voluntary. You may choose not to provide it without affecting core functionality.
8. Who We Share Personal Information With
We share personal information only as necessary for the purposes set out above, with:
- Carriers and Shippers: limited contact and booking details necessary for the selected party to perform or receive the transport service
- Payment gateway (PayFast or successor gateway): to process payments securely
- Hosting, IT and cloud service providers: who host or support the Platform under appropriate operator agreements
- Professional advisers: lawyers, accountants and auditors where required
- Regulators and law enforcement: where we are legally required to disclose information
We do not sell personal information. Where we use operators (service providers who process information on our behalf), we require them to process it only on our instructions and to implement appropriate security measures.
9. Cross-Border Transfers and Foreign Hosting
The Mov-IX Platform (including the website, databases and related systems) is hosted on cloud servers that may be located outside the Republic of South Africa (including, without limitation, in the United States of America or other jurisdictions). As a result, your personal information may be transferred to, stored on, and processed by servers and service providers outside South Africa.
Any such transfer is made in accordance with section 72 of POPIA. We rely principally on binding contractual safeguards with our hosting and other service providers that impose protections substantially similar to the conditions for lawful processing under POPIA, and on the fact that the transfer is necessary to conclude or perform our contract with you. We also require operators to maintain appropriate technical and organisational security measures under section 21 of POPIA.
If you have questions about specific transfers or the countries involved, please contact our Information Officer at privacy@mov-ix.co.za. Details of the categories of recipients and the countries in which they process personal information are available from the Information Officer on request.
10. Cookies and Similar Technologies
We use cookies and similar technologies to operate the Platform, remember preferences, analyse traffic and improve performance. Essential cookies are necessary for the site to function. Analytics and marketing cookies (if used) are subject to your consent where required.
You can manage cookie preferences through your browser settings or any cookie consent tool we provide. Disabling certain cookies may affect Platform functionality.
11. Security Safeguards
We implement appropriate technical and organisational measures to protect personal information against loss, damage, unauthorised access, destruction or alteration. These include:
- Secure HTTPS connections
- Access controls and authentication (including verification of email and phone)
- Encryption of sensitive data in transit and, where appropriate, at rest
- Regular review of security practices
- Staff and operator awareness of confidentiality obligations
No system is completely secure. You are responsible for keeping your login credentials confidential.
12. Retention of Personal Information
We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law (for example tax, accounting or dispute-resolution periods). Typical retention periods include:
- Account and transaction records: for the duration of the account relationship plus a reasonable period thereafter (commonly up to 5 to 7 years for financial records)
- Support and communication records: for a reasonable period after resolution of the matter
- Marketing data: until you unsubscribe or withdraw consent
When information is no longer required we will securely delete or de-identify it.

Under POPIA you have the following rights (subject to the limitations in the Act):
- Access: to request confirmation of whether we hold your personal information and to obtain a copy
- Correction: to request correction of inaccurate, incomplete or out-of-date information
- Deletion / destruction: to request deletion of information that is no longer necessary or that was unlawfully processed
- Objection: to object to processing on reasonable grounds relating to your particular situation
- Restriction: to request restriction of processing in certain circumstances
- Withdrawal of consent: where processing is based on consent, to withdraw it at any time (this does not affect prior lawful processing)
- Complaint: to lodge a complaint with the Information Regulator
To exercise any of these rights, please contact our Information Officer at privacy@mov-ix.co.za. We may need to verify your identity before responding. Requests for access to personal information are handled in accordance with the Promotion of Access to Information Act 2 of 2000 ("PAIA") and our PAIA manual, available on the Platform and at our principal place of business; a prescribed fee may apply, and we will respond within 30 days as required by PAIA. We do not make decisions that have legal consequences for you based solely on automated processing of personal information, as contemplated in section 71 of POPIA.
You also have the right to lodge a complaint with the Information Regulator of South Africa:

14. Security Compromises (Data Breaches)
If we become aware of a security compromise that affects your personal information, we will notify the Information Regulator and, where required by POPIA, notify affected data subjects as soon as reasonably possible after discovery, providing information about the nature of the compromise and steps taken.
15. Direct Marketing
We will only send you direct marketing communications (e.g. newsletters, promotional offers) in accordance with section 69 of POPIA: with your consent (which we may request once, in the prescribed manner), or where you are an existing customer, your details were obtained in the context of a sale of a product or service, the marketing relates to our own similar products or services, and you were given a reasonable opportunity to object, free of charge, when your details were collected and in each communication. You may unsubscribe at any time by using the link in the communication or by contacting us.
Service-related messages (booking confirmations, delivery updates, account notices) are not marketing and will continue to be sent as necessary.
16. Children
The Platform is not directed at children under 18. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us so that we can delete it.
17. Changes to this Privacy Policy
